Subscription conditions

Effective from 31 October 2024

1. General Conditions

  • These General Terms and Conditions (hereinafter referred to as “GTC”), together with the subscription for dental maintenance and its cover letter (hereinafter referred to as “Subscription”), govern the legal relationship between Swiss Dental Network SA and the Client. The GTC apply in their current form at the time of treatment.

  • The Client is obligated to inform the Contractor or treating dentist of all relevant information, such as health issues, allergies, pregnancies, pacemakers, etc., before each appointment. Treatments follow recognized standards of dentistry; however, no guarantee of specific outcomes can be provided.
  • All medical interventions carry certain risks, which will be communicated prior to treatment, including available options, risks, and associated costs. Before the treatment, the client is informed about the various treatment options, as well as the most common risks and costs associated with them.
  • If dissatisfied with a treatment, the Client must notify Swiss Dental Network SA in writing within 10 days.

4. Cancellation of Booked Treatment Appointments

  • Appointments are binding, and the time is reserved exclusively for the Client. If unable to attend, the Client must notify Lovely Smile at least 48 hours in advance by email at info@lovelysmile.ch. If the cancellation is made too late or if the client does not show up for the appointment without cancelling in good time, Swiss Dental Network SA reserves the right to charge the client a contribution towards expenses. Late cancellations or no-shows will incur a fee:
  • CHF 150.00 for appointments up to one hour.
  • CHF 250.00 for appointments over one hour.

5. Payment Conditions

  • Payment terms are outlined in the subscription agreement.
  • The first reminder is free of charge; subsequent reminders incur a fee.
  • Late payments accrue 5% annual interest from the due date without additional reminders.
  • If an invoice from Swiss Dental Network SA is still unpaid after the third reminder, Swiss Dental Network SA reserves the right to initiate debt collection proceedings through a third-party provider.
  • Non-payment is grounds for immediate subscription cancellation.

6. Liability

  • The Contractor’s liability is limited to gross negligence or intent. Liability for slight negligence or breaches of duty by auxiliary persons is excluded to the extent permitted by law.

7. Data Protection

  • The privacy policy on www.lovelysmile.ch outlines the handling of personal data. Please read them carefully.
  • The Client consents to receiving newsletters and communications.
  • The Contractor will cease all communication and delete personal data upon the Client’s written request.

8. Applicable Law and Place of Jurisdiction

  • Swiss law applies without consideration of Swiss private international law.
  • Jurisdiction is at the Contractor’s registered office, the Client’s domicile, or Bern.

9. Severability Clause

  • If parts of the GTC or subscription are invalid, the remaining provisions remain unaffected. Invalid provisions are replaced with statutory provisions or the presumed intent of the parties.

10. Amendment of these GTC

  • Swiss Dental Network SA may amend these GTC at any time. Amendments will be communicated appropriately and are considered accepted unless the Client objects in writing within seven days.
